Kampenwand Cable Car - Replacement With Detachable 8-Seater Gondola Lift Approved
With a decision dated June 24th, 2022, the district office of Rosenheim approved the change to the building and operating permit of January 5th, 2017 for the new construction of a detachable 8-seater, as requested by “Kampenwandseilbahn GmbH”, An der Bergbahn 8, 83229 Aschau im Chiemgau, with an application dated March 30th, 2019 -Cable car granted under conditions and ancillary provisions.
The current cable car up to Kampenwand, near Aschau, is in the German state of Bavaria. It was built in 1957. A ride to the 1,500-metre-high (4,900 ft) summit station takes approximately 14 minutes
The district office in Rosenheim, as the locally and factually responsible district administration authority (Art. 14 Para. 1 and Art. 25 Para. 1 BayESG), had to check whether the requirements for changing the approval for the construction and operation of a detachable 8-seater gondola lift were met.
According to Art. 13 Para. 5 BayESG, these requirements are met if operational safety can be assumed, there are no facts that indicate the unreliability of the person or persons who manage the cable car company (company of a cable car) or their representatives legal entities of the person authorized to represent by law or the articles of association - shows that the project does not run counter to public interests and that an environmental impact assessment (EIA) has been carried out in the cases of Art. 13 Para. 2 to 4 BayESG.
An environmental impact assessment was carried out in 2016 for the cable car, which is subject to approval under Article 13 Paragraph 1 BayESG, in accordance with Article 13 Paragraphs 2, 3 and 4 BayESG and supplemented for the amendment in 2019 and 2021.
On the one hand, the authorities whose area of responsibility is affected by the procedure were involved (Art. 73 Para. 2 BayVwVfG). On the other hand, the German Alpine Club e. V., BUND Naturschutz in Bayern e. V., State Association for Bird Protection in Bavaria e. V. and the Association for the Protection of the Mountain World e. V. as associations according to Art. 73 Para. 4 S. 5 BayVwVfG. Finally, the municipality of Aschau im Chiemgau gave its consent to the project.
From the point of view of environmental compatibility, the planned project for the construction of a detachable 8-seater gondola corresponds to the legal requirements. Although there are impairments to individual protected assets, these can be compensated for within the framework of the avoidance, reduction, compensation and replacement measures to be guaranteed during project implementation. The corresponding avoidance, reduction, compensation and replacement measures are shown in the environmental compatibility study and in the accompanying landscape conservation plan, which are part of the building and operating permit, and are secured by corresponding conditions and ancillary provisions in the notification.
